Anyone wishing to speak before the Planning and Zoning Board must sign in prior to the meeting, stating name, address and topic to address.  Speakers making public comment will be sworn in.  All comments will be limited to two minutes.

1.   PLANNING & ZONING BOARD AGENDA APPROVAL

 

Action Request:                    Motion to approve or approve with modifications the            

May 17, 2018 Agenda.

 

Switch order to 4 & 5 Comp Plan amendment to moved to be heard first, then rezone. Randy moved, Mrs. Sharon second all in favor. Sharon moved, all in favor Item # 6 and #7 to have the Comprehenive plan heard first, then the rezone. Mr. Price moved, Mrs. Tarman second, all in favor 5-0.

2.   APPROVAL OF MEETING MINUTES                                                               (TAB 1)          

 

Action Request:                    Motion to approve or approve with modifications the

April 26, 2018 Minutes.

            Mr. Price moved, Sharon second and the motion carried 5-0 to approve.

 

3.   PUBLIC COMMENT

 

None

 

Public Comment:  Comments shall be limited to two minutes.  The Board does not generally take action on any matter raised during these public comments, but may direct the matter to be placed on the agenda of a future meeting, if appropriate.

 

 

4.   Ordinance 2018-12 (K. Owens)                                                               (TAB 2)          

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, ZONING APPROXIMATELY  7.6 ACRES OF PROPERTY, GENERALLY LOCATED AT 1550 US 301 NORTH, PALMETTO, FL 34221, PID# 2582900003, FROM COUNTY URBAN DEVELOPMENT ZONE TO CITY BUSINESS AND LIGHT COMMERCIAL (CG), AND AS MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

This item was continued from the April 26, 2018 Planning and Zoning Board Meeting.

  Sharon moved, price second all in favor 5-0.

Action Request:                        Based upon the evidence presented and finding the request to be either consistent or inconsistent with the Comprehensive Plan and the Code of Ordinance, I move to recommend approval, approval with modifications, or deny the request for Ordinance 2018-12.

 

5.   Ordinance 2018-13 (K. Owens)                                                               (TAB 3)

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA APPROVING A SMALL SCALE FUTURE LAND USE MAP AMENDMENT TO THE CITY’S COMPREHENSIVE PLAN; CHANGING THE FUTURE LAND USE MAP DESIGNATION FOR THE TERRITORY HEREINAFTER DESCRIBED FROM CITY FUTURE LAND USE MAP DESIGNATION  PC, PLANNED COMMUNITY, TO CITY FUTURE LAND USE MAP DESIGNATION GCOM, GENERAL COMMERCIAL, CONSISTENT WITH THE GOALS, OBJECTIVES, AND POLICIES OF THE ADOPTED COMPREHENSIVE PLAN, AS REQUIRED BY  SECTION 163.3187, FLORIDA STATUTES; PROVIDING FOR  CONFLICT, SEVERABILITY, AND AN EFFECTIVE DATE. (CIVIX PROPERTY)

 

Action Request:                        Based upon the evidence presented and finding the request to be either consistent or inconsistent with the Comprehensive Plan and the Code of Ordinance, I move to recommend approval, approval with modifications, or deny the request for Ordinance 2018-13.

Sharon moved to approve, price senond all in favor 5-0.

 

  Property was annexed into the City in 2006, previous developer.

Request is to change the FLU from PC to GCOM. Anticipated into divide the property into (3)

parcels.  Daycare, Extend stay hotel, projected at this time. Discussion ensued regarding the possibility of this project triggering a light an canal road.

Discussion ensued that the uses are not the discussion at hand.

Brian Vance – 1994 owns a manufacturing business adjacent to the property has no objection to  commercial zoning, but opposes having childcare on the property with the running truck into the night.

Rod Connelly the main componets are the hotel, the storage. Daycare is at the end of.

6.   Ordinance 2018-08 (K. Owens)                                                   (TAB 4)                                  

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, REZONING APPROXIMATELY  9.3 ACRES OF PROPERTY, GENERALLY LOCATED AT 917 11TH AVENUE WEST, PALMETTO, FL 34221, PID#’S 2707900003, 2707500050, 2707500506, FROM HEAVY COMMERCIAL AND LIGHT INDUSTRIAL (CHI) TO PLANNED DEVELOPMENT MIXED USE (PD-MU), AND AS MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

7.   Ordinance 2018-09 (K. Owens)                                                   (TAB 5)                      

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, AMENDING ORDINANCE 2010-01; TO APPROVE AN AMENDMENT TO THE FUTURE LAND USE MAP TO CHANGE AN 9.3 ACRES PARCEL, FROM HEAVY COMMERCIAL INDUSTRIAL (HCOMIND) TO PLANNED COMMUNITY (PC), FOR A PARCEL OF LAND GENERALLY LOCATED AT 917 11TH AVENUE WEST, PALMETTO, FL, PID#’S 2707900003, 2707500050, 2707500506, AND AS MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

  PD-Mu with mixed use, that would encompass a commercial component. 

 

The south right-of-way was discovered that has a FLU designation, and may need to be in the future to be re designated if the applicant moved forward with the GDP. Discussion ensued regarding concerns with the mixed use, that could potentially become commercial on the subject property.

Ed Vogler –

 

Suzy Cannon lives on 8th St W. Concerned with the commercial components that are projected, and the neighbor’s privacy.

Gary Guthrie – still operating the business as a fertilizer plant.

Donna Cunz 1210 8th St W, concerned with the traffic, and privacy.

 

Christopher Walker – Recommended the applicant to come back with all the pieces of the GDP at once.

Mr. Price moved to continue 2018-09 2018-08 to the June 14, 2018 PZ meeting. , Sharon seconded, motion was removed.

2018-09 jon moved to recommend approval without modifications, the motioned, second 3-0 opposed.

Applicant has agreed to move.

Mrs. Tarman moved 2018-08 to June 14, 2018 all in favor 5-0

Mr. Price moved 2018-08, tarman seconded all in favor 5-0.

8.   Ordinance 2018-10 (K. Owens)                                                               (TAB 6)          

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, APPROVING A CONCEPTUAL/GENERAL DEVELOPMENT PLAN FOR A 204-UNIT, MULTI-FAMILY RESIDENTAL PROJECT ON AN 9.3-ACRE SITE ZONED PD-MU, AND GENERALLY LOCATED AT 917 11TH AVENUE WEST, PALMETTO, FL, PID#’S 2707900003, 2707500050, 2707500506, AND AS MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

This item was continued from the April 26, 2018 Planning and Zoning Board meeting.

This item has been requested by staff to be continued to a future Planning and Zoning Board meeting, date and time certain.

  Mr. Ruducille requested the board to open public comment that may not be able to attend the June 14, 2018.

Public comment was left open, with no comments at this time.

Sharon moved, all in favor 5-0.

Action Request:                        Motion to continue Ordinance 2018-10 to a future Planning and Zoning Board meeting, date and time certain.

 

9.   Ordinance 2018-11 (K. Owens)                                                               (TAB 7)

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, AMENDING CHAPTER 6, ARTICLE I, SECTION 6-1 OF THE PALMETTO CODE OF ORDINANCES, BIRD SANCTUARY, TO PROHIBIT THE HARBORING OR KEEPING OF CHICKENS EXCEPT IN CONFORMANCE WITH CITY REGULATIONS, AMENDING CHAPTER 6, ARTICLE II, SECTION 6-31 OF THE PALMETTO CITY CODE OF ORDINANCES, TO REGULATE CHICKEN-KEEPING WITHIN CITY LIMITS; PROVIDING DEFINITIONS; PROHIBITING ROOSTERS, FOWL, OR POULTRY OTHER THAN CHICKENS; PROVIDING GENERAL REQUIREMENTS FOR ENCLOSURES, LOCATION, AND MAINTENANCE; PROVIDING FOR EXCEPTIONS; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.

Action Request:                        Based upon the evidence presented and finding the request to be either consistent or inconsistent with the Comprehensive Plan and the Code of Ordinance, I move to recommend approval, approval with modifications, or deny the request for Ordinance 2018-11.

  Mrs. Owens explained that has been problems with fowl, primiarily roosters. The ordinance amendment would prohibit roosters, but allows to keep up to 6 hens on a property, but have to be contained. This protains to resential lots in the city, and excludes MHp- 1 and multi-family.  Change 3. (d) to change to nearest property line.

Mr. Walker

Jon moore 4 h program. Schools allows faciliaties at the school to raise the animal. Schools are in a P zoning that are excluded from this ordinance. Section 6.1 in FLA Statues Sharon seconded, all in favor 5.0

10. Old Business                                                                                                        

Mr. Price moved to move the PZ meeting to June 21 to June 14. Tarman second, all in favor.                                                                             

11. New Business                                                                                                        

Amendment was made to change 5 members.

12. Adjournment

Stat. §286.0105).
