Magistrate Regina Kardash called the meeting to order at 6:00 p.m., followed by a moment of silence and the Pledge of Allegiance. Ms. Kardash explained the quasi-judicial procedures of this hearing. All people planning to address the Magistrate were duly sworn.

Magistrate Kardash approved the January 28, 2020 and February 25, 2020 Citation Appeal Hearing Minutes and the January 28, 2020 Code Enforcement Hearing Minutes as written.

SETTLEMENT: The Respondent has brought the property into compliance, the case was dismissed by the Code Enforcement Officer on February 13, 2020 and no further action is needed.

Code Enforcement Officer Shawn Williams presented details pertaining to the case. Evidence was presented to Magistrate Kardash for her consideration and made a part of these minutes. The initial site visit was January 7, 2020 and as of June 30, 2020, the property is still out of compliance. Representatives from the address were not present to offer additional testimony.
STIPULATION: Magistrate Kardash found the property in violation of the City Code of Ordinances, specifically Section 16.26(2) and the Respondent was given until July 27, 2020 to bring the property into compliance. The case will be heard again July 28, 2020.

Codes Violated: Chapter 7, Section 7-183- No fence or wall shall be erected until a permit is obtained from the building inspector.
Code Enforcement Officer Shawn Williams presented details pertaining to the case. Evidence was presented to Magistrate Kardash for her consideration and made a part of these minutes. The initial site visit was March 9, 2020 revealing improvements to a fence, with only a previous fence permit on file that expired 2010.
Magistrate Kardash clarified that Chapter 7, Section 7-183 is about fence being in right-of-way or on a City street. Corrected Muni-code should be 7-182.
Respondent Travis Longpre clarified that the fence was already erected and he was just replacing rotten wooden panels. The chain link fence was completed as well as the privacy fence. Mr. Longpre brought the original permit for the Magistrate’s consideration.
Shawn Williams stated chain link was erected, but it appeared that a new privacy fence was being installed.
Magistrate Kardash suggested Mr. Longpre speak with the Building Official, David Wilcox to verify that the fence meets all requirements. The original permit was for a chain link and a wooden fence. Permit was dated 8/31/2009, and was submitted to the Magistrate to be made a part of these minutes, as well as City Ordinance 2018-03.

SETTLEMENT: Magistrate Kardash dismissed the case, not finding any violation of Section 7-183 as written, but suggested the Respondent to go to Building Department to verify the fence is compliant to code.
4. OLD BUSINESS
Code Enforcement Officers brought no pending code cases before the Magistrate in February, so there was no Code Hearing held on February 25, 2020. The Code Enforcement Hearing originally scheduled April 7, 2020 was postponed due to Coronavirus health concerns and Executive Order(s) 20-91 and 20-92 from Governor DeSantis.
5. NEW BUSINESS
The next Code Enforcement Hearing is scheduled for Tuesday, July 28, 2020.
