Mayor Bryant called the meeting to order at 7:00 p.m., followed by a moment of silence and the Pledge of Allegiance.
All persons intending to address the City Commission were duly sworn.
NEW OFFICER SWEARING IN: Chief Scott Tyler swore in Officer Kevin Gonzalez, Officer Madison Peters, and Reserve Officer Casey Odell
1. CITY COMMISSION AGENDA APPROVAL
Mayor Bryant announced that the City received a letter from Bonita Vista Attorney Alan Prather asking for a continuance of the General Development Plan (GDP) hearing from tonight to June 19th. Due to that, Mayor Bryant asked that that item become item 2.A. on tonight’s agenda.
Motion: Commissioner Davis moved, Commissioner Smith seconded, and the motion carried 5-0 to approve the June 5, 2017 Agenda with item 8 becoming item 2.A.

8. PUBLIC HEARING ORDINANCE 2017-03 BONITA VISTA GENERAL DEVELOPMENT PLAN
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, PROVIDING FOR FINDINGS OF FACT; APPROVING A CONCEPTUAL/GENERAL DEVELOPMENT PLAN FOR AN 18-UNIT, THREE-STORY MULTI-FAMILY BUILDING ON A 0.90-ACRE SITE ZONED PD-H AND LOCATED GENERALLY AT THE SOUTHWEST CORNER OF 14TH AVENUE WEST AND 23RD STREET WEST, PALMETTO, FLORIDA; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
Mayor Bryant opened the public hearing continued from April 3, 2017.
Attorney Barnebey announced that Attorney Alan Prather, representing this project, asked for a continuance to the June 19th Commission meeting. He recommends that the City approve the continuance as requested.
Motion: Commissioner Williams moved, Commissioner Davis seconded, and the motion carried 5-0 to continue the public hearing on Ordinance 2017-03 to June 19, 2017 at 7:00 p.m. or as soon thereafter as same can be heard in these Chambers.

Motion: Commissioner Davis moved, Commissioner Cornwell seconded, and the motion carried 5-0 to approve the June 5, 2017 Consent Agenda and the addition that with the approval of the Special Function Permit for the Skyway Run it does not mean the City is sponsoring the event or taking full responsibility.
4. 1ST READ ORDINANCE 2017-10 SITE PLAN
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, AMENDING THE PROVISIONS FOR THE PROCESSING OF SITE PLANS PURSUANT TO THE ZONING CODE AS CONTAINED IN THE CODE OF ORDINANCES; PROVIDING FOR CODIFICATION, PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.
Motion: Commissioner Davis moved, Commissioner Williams seconded, and the motion carried 5-0 to schedule Ordinance 2017-10 for a Public Hearing on August 7, 2017 at 7:00 p.m. or as soon thereafter as same can be heard in these Chambers and direct staff to advertise for same.
5. PUBLIC HEARING ORDINANCE 2017-08 LOST/ABANDONED VESSELS
AN ORDINANCE OF THE CITY COMMISSION FOR THE CITY OF PALMETTO, FLORIDA, ADOPTING REGULATION OF LOST AND ABANDONED VESSELS; PROVIDING FOR PURPOSES AND FINDINGS; PROHIBITING LOST AND ABANDONED VESSELS; PROVIDING FOR ENFORCEMENT AND PENALTIES; PROVIDING FOR REMOVAL, STORAGE AND DISPOSAL OF LOST OR ABANDONED VEHICLES; PROVIDING FOR COSTS AND LIENS; PROVIDING FOR PROCUREMENT OF SERVICES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
Mayor Bryant opened the public hearing.
Attorney Barnebey is doing some research and would like to include some of the language he has found into the current Ordinance. He would like to continue this public hearing to August 7th with a Workshop on July 17th.
Motion: Commissioner Williams moved, Commissioner Varnadore seconded, and the motion carried 5-0 to continue the Public Hearing on Ordinance 2017-08 to August 7, 2017 at 7:00 p.m. or as soon thereafter as same can be heard in these Chambers and a Workshop on July 17th.
6. PUBLIC HEARING ORDINANCE 2017-06 VACATION OF RIGHT OF WAY
AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, VACATING A PORTION OF A PUBLIC RIGHT-OF-WAY, CONTAINING APPROXIMATELY 15,212.80 SQUARE FEET, AND LOCATED BETWEEN 14TH AVENUE WEST AND 13TH STREET WEST; SAID PARENT PARCEL IS LOCATED GENERALLY AT 312 14TH AVENUE WEST, PID#3130200052, AND AS MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.
Mayor Bryant opened the public hearing.
Karla Owens, City Planner, informed Commission that the applicant David Jefferies is the personal representative of the estate of Willadine P. Jefferies and currently owns the property. He has a contract for sale of the property and discovered that a portion of the driveway along with the carport and concrete slabs are located outside the side boundary of the parcel. In addition, the property immediately to the east owned by the Elliott's and located at 311 13th Avenue West also has permanent accessory structures which are actually located outside of their side parcel line and within the easement area. Mr. Jefferies and his neighbors would like to have clear title and ownership of the property within the right-of-way to accommodate the existing accessory structures in this area which are currently located within the right-of way. There are a total of five (5) parcels which abut this right-of-way including the Jeffries property, two of which are owned by the same person. Mr. Jeffries has contacted the other four owners along the right-of-way and all owners have consented in writing to the proposed vacation. Should Commission approve this vacation, the right-of-way will be legally divided between the four property owners abutting the right-of-way.
Mayor Bryant closed the public hearing after public comment.
Motion: Commissioner Williams moved, Commissioner Davis seconded, and the motion carried 5-0 to adopt Ordinance 2017-06.
7. PUBLIC HEARING ORDINANCE 2017-07 TERRA CEIA TOWNHOMES GENERAL DEVELOPMENT PLAN
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, PROVIDING FOR FINDINGS OF FACT; APPROVING A CONCEPTUAL/GENERAL DEVELOPMENT PLAN FOR A 22-UNIT, ONE-STORY RESIDENTIAL VILLAS PROJECT ON A 3.42-ACRE SITE ZONED PD-H AND GENERALLY LOCATED WEST OF 14TH AVENUE WEST AND SOUTH OF TERRA CEIA BAY CLUBHOUSE & GOLF; SAID PARCEL IS PID#2416820005, PALMETTO, FLORIDA, AND AS MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE.
Mayor Bryant opened the public hearing.
Mrs. Owens informed Commission that, due to the Bonita Vista General Development Plan (GDP) that was on the agenda tonight, she requested a continuance for this public hearing. Seeing that the Bonita Vista GDP was continued, the applicant is here and ready to proceed with a public hearing if the Commission so chooses. It was noted that this Ordinance was advertised in the newspaper as well as to the surrounding property owners for today’s date; however, the agenda did indicate it would be opened tonight and continued to June 19th. Attorney Barnebey indicated it would be best to continue this public hearing to June 19th as the agenda had indicated to allow any public that saw the agenda time to attend the June 19th meeting to speak.
Mayor Bryant called for any public that wanted to comment on this issue tonight that could not attend on June 19th. There was no response.
Motion: Commissioner Davis moved, Commissioner Cornwell seconded, and the motion carried 5-0 to continue the Public Hearing on Ordinance 2017-07 to June 19, 2017 at 7:00 p.m. or as soon thereafter as same can be heard in these Chambers.
Mayor Bryant recessed the City Commission meeting at 7:41 p.m. to open the June 5, 2017 CRA Board meeting.
Mayor Bryant reconvened the City Commission meeting at 8:34 p.m.
9. RIVERSIDE BUS STOPS
Motion: Commissioner Cornwell moved, Commissioner Williams seconded, and the motion carried 5-0 to approve the CRA designed bus stops for Riverside Park East and West.
10. SURPLUS 320 10TH AVENUE WEST
Mr. Burton explained that this is a request for surplus of the parcel, he is not seeking to sell or do anything to the property other than surplus it. Concerns were expressed about developing that parcel (currently a parking lot) and losing all the public parking spaces. Mr. Burton stated that it would be a good idea to include in the development contract that that parcel remain a parking lot until the CRA can obtain at least the same amount of parking spaces for the public in the downtown vicinity.
Motion: Commissioner Davis moved, Commissioner Smith seconded, and the motion carried 5-0 to surplus property located at 320 10th Avenue West.
11. TRAFFIC UPDATE
Mayor Bryant sent a letter to the City of Bradenton regarding the red light camera at 3rd Avenue (base of Green Bridge, south side) and the effect it has on traffic. She spoke to City of Bradenton Mayor Poston who indicated he read the letter and assured the Mayor that the operation of the red light camera does not impact traffic heading south over the Green Bridge.
It was discussed that the City could speak with the Florida Department of Transportation (FDOT) since it is an FDOT road.

14. DEPARTMENT HEADS’ COMMENTS
Mr. Freeman—plans to bring forward a proposed budget meeting calendar for July and August. The June 1st estimates that he received showed an increase of values at approximately 6 percent City wide. He also plans to discuss the half-cent sales tax and the projects that are a priority to the Commission for the City with the receipt of those monies.
He announced that the Yellow Fever Cemetery project is coming to a close. The lights at the cemetery are now turned on.
Mr. Tusing—updated Commission on the Historical Park grant. He stated that work will begin shortly on the Carnegie Library windows.
Mrs. LaRowe—asked Commission to make a formal motion approving the Fourth of July event so that she can send a copy of the minutes to the Florida Department of Transportation to attach to the road closure permit for the Green Bridge.
Motion: Commissioner Davis moved, Commissioner Cornwell seconded, and the motion carried 5-0 to approve the Fourth of July event.
15. MAYOR’S REPORT
Mayor Bryant asked the Commission to respond to Mrs. Johnston regarding attendance to the Florida League of Cities conference this year.
She attended the event at Sutton Park on Saturday for Cappy’s Cause. It was well attended and she enjoyed seeing a lot of people attending the event for a good cause.
16. COMMISSIONERS’ COMMENTS
Commissioner Williams—asked if the Mayor’s office has received the Florida League of Cities resolution packet. If not, he will be requesting some information be sent to Mrs. Johnston so that if the City has any resolutions they can be forwarded to the League by July 12th.
Commissioner Cornwell—questioned Mr. Tusing about any drainage issues along 10th Street near Publix. Mr. Tusing was unaware of any issues; Mrs. Cornwell told him she would meet with him after the meeting to show him the location.
Mayor Bryant adjourned the meeting at 8:58 p.m.
